Uninsured and Underinsured Motorists
If you are hurt in a car accident caused by another driver’s negligence, you have the right to expect compensation for your medical bills, lost wages, pain and suffering and other losses. Generally, your costs and general damages are paid by the at-fault driver’s liability insurance when you make a personal injury claim. This is called a “tort claim.” Unfortunately, many drivers carry only the minimum liability coverage required by Ohio law.
If the uninsured or underinsured driver who hit you has only the minimum liability insurance, it may not cover all of your losses. If you carry uninsured or underinsured motorist coverage (UM/UIM) coverage, which we suggest that you buy to best protect you and your family, we will make a claim against your own insurance company to cover the balance of your losses. This is called a “contract claim.” It is a highly complex series of laws and most people do not understand the nature and extent of these types of cases.
